Liquor License Review Committee

LLRC MEETING MINUTES

March 21, 2011

5:30 p.m. Plymouth City Hall

 

1)   ROLL CALL – Dan Dwyer, David Workman, Ed Hingelberg

 

2)   ANNUAL REVIEW OF LIQUOR LICENSE RENEWALS – The LLRC holds annual hearings for all liquor by the glass serving establishments to help insure compliance with the City’s Liquor Management Ordinance and to make recommendations to the City Commission for the renewal, revocation and non-renewal of liquor licenses in the City.  The City Administration presented a report to the LLRC which indicated that 18 of the City’s 22 establishments be recommended for approval.  Based on a review of the report and consultation with the City’s Police Chief the following Resolution was offered by Member Hingelberg and Seconded by Member Workman.

WHEREAS     The City of Plymouth Liquor License Review Committee

                   Has the duty to make an annual review of all liquor

                   Serving establishments in the City, and

WHEREAS     The City Administration has spent a considerable amount

                   Of time assisting the LLRC with this review, and

WHEREAS     It is the duty of the LLRC to make certain recommendations

                   To the City Commission.

NOW THEREFORE BE IT RESOLVED THAT the LLRC does hereby make the following recommendations to the Plymouth City Commission related to the renewal of liquor licenses in the City of Plymouth.

1)   License Holder – Buon Vino Winery, LLC, 849 Penniman - Administrative Recommendation to approve renewal.

 

2)   License Holder – 336 Main, 336 S. Main - Administrative Recommendation to approve renewal.

 

3)   License Holder – Compari’s on the Park 350 S. Main - Administrative Recommendation to approve renewal –

 

4)   License Holder – Doyle’s Tavern, 860 Fralick - . Administrative Recommendation to approve renewal.

 

5)   License Holder – City of Plymouth Parks and Recreation – Administrative Recommendation to approve renewal

 

6)   License Holder – Grape Expectations Wine Bar & Merchant, 555 Forest - Administrative Recommendation to approve renewal.

 

7)   License Holder – Hermanns Olde Towne Grill, 195 W. Liberty - Administrative Recommendation to approve renewal.

 

8)   License Holder – Ironwood Grill, 840 W. Ann Arbor Trail - Administrative Recommendation to approve renewal.

 

 

9)   License Holder – Mayflower Meeting House, Executive Catering, Inc. 499 S. Main - Administrative Recommendation to approve renewal.

 

10)License Holder – Mayflower – Lt. Gamble Post 6995 of the Veterans of Foreign Wars of the United States, 1426 S. Mill Street - Administrative Recommendation to approve renewal.

 

11)License Holder – Nico & Vali – Italian Eatery, 744 Wing Street - Administrative Recommendation to approve renewal.

 

12)License Holder – Plymouth Knights of Columbus Building Council #3292, 150 Fair Street - Administrative Recommendation to approve renewal.

 

13)License Holder – The Box Bar, 777 W. Ann Arbor Trail - Administrative Recommendation to approve renewal.

 

14)License Holder – The Penn Grill, 820 Penniman - Administrative Recommendation for renewal

 

15)License Holder – Liberty Street Brewing – Norton X Brewing LTD, 149 W. Liberty - Administrative Recommendation to approve renewal.

 

16)License Holder – Station 885 – 885 Starkweather - Administrative Recommendation for renewal

 

17)License Holder – Plymouth Crossing – Jack Dunleavy’s Plymouth Grill – 340 N. Main - Administrative Recommendation for renewal

 

18)License Holder – Plymouth ROC – Boulders, Inc. – 1020 W. Ann Arbor Road - Administrative Recommendation to approve renewal

 

MOTION PASSED

 

3)   HEARING ON E.G. NICKS – T. BELI & ASSOC., INC. – Due to outstanding bills that have not been paid to the City including bills due for past due tax collections and water bills a separate hearing was held on this establishment.  The City Administration recommended non-renewal.  Based on the presentation of the ownership group indicating that they would have all bills paid by March 29, 2011 it was moved by Member Dwyer and seconded by Member Workman to recommend approval of the Liquor License for E.G. Nicks to the City Commission pending final payment for outstanding bills due to the City on or before March 29, 2011.

4)   HEARING ON ROCK BAR & GRILL – Due to outstanding issues with the Wayne County Health Department a separate hearing was held on this establishment.  The City Administration recommended non-renewal of the license.   Based on the presentation of the ownership group there was an indication that the establishment is working with the Wayne County Health Department to resolve all of the 33 items listed in the County’s most recent February 23, 2011 letter to the ownership group.  The ownership indicated that they are working with a consultant on resolving these issues.  Based on the presentation it was moved by Member Dwyer and seconded by Member Hingelberg to recommend to the City Commission approval of the Liquor License for Rock Bar and Grill to the City Commission.

MOTION PASSED

 

5)   HEARING ON 1999 TAVERN – W.G.A.C.A. – Due to a number of outstanding issues related to non-payment of bills due to the City, failure to complete the liquor license transfer, State of Michigan Liquor Control Violations, including failure to complete the liquor license transfer, serving alcohol to minors and serving alcohol while the license was suspended; the City Administration recommended non-renewal and revocation of the license.  A separate hearing before the LLRC was held.  The Ownership Group has indicated that they have completed the transfer of the Liquor License from W.G.A.C.A. to Lucky 7 out of 14.  The ownership indicated that they will have all past due bills paid to the City on or before March 29, 2011 and that they are in the process of selling the liquor license to another vendor.  Based on the presentation of the ownership group the following Resolution was offered by Member Hingelberg and seconded by Member Workman to recommend to the City Commission approval of the Liquor License Renewal for 1999 Tavern pending final payment of $6,776.78 of past due bills due to the City of Plymouth on or before March 29, 2011.

MOTION PASSSED

6)   HEARING ON SEAN O’CALLAGHAN”S PUBLIC HOUSE – Due to a past due tax bill by the building’s owner and a high number of police contacts including a major assault where one victim has a portion of his ear bitten off the City Administration recommended non-renewal of the liquor license.  The ownership of the establishment indicated that the past due tax bill was not his and was the building owner’s responsibility.  In addition, he indicated that he has enough staff working the floor to prevent over serving.  Based on the presentation of the ownership group the following Resolution was offered by Member Workman and seconded by Member Dwyer that the LLRC Recommend to the City Commission renewal of the Liquor License pending final payment of the past due building owner tax bill.

MOTION PASSED

 

7)   ADJOURNMENT – There being no further business to come before the LLRC it was moved by Member Hingelberg and seconded by Member Workman to adjourn the meeting.
